JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report and submission on his behalf is that his name surfaced in this case in confessional statement of co-accused, Sonu Burnwal, who has already been granted privilege of bail by a co-ordinate Bench of this court.
From perusal of the impugned order it would appear that the victims of the present case stated before the police that culprits were taking the name of Sonu, Monu, Ranjan etc. and it appears that except the aforesaid material, there is nothing against the petitioner. Admittedly, petitioner has not been put on Test Identification Parade and except one case of Arms Act, he does

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Jamui in connection with Jhajha P.S. Case No. 18 of 2015.
