JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-03-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 379, 382 and some other ancillary Sections of the Indian Penal Code. As per the prosecution case, co-accused, Gulshan Kumar snatched cash of Rs. 10,000/- and mobile of the informant, who disclosed the name of petitioner as one of his associates.

Learned counsel appearing for the petitioner submits that petitioner is not named in the FIR. The name of petitioner has transpired in this case in the confessional statement of coaccused, Gulshan Kumar, who was apprehended on the spot. No incriminating article has been recovered from the possession of the petitioner. Petitioner claims clean antecedent .

Considering the facts of the case, nature of accusation and clean antecedent of the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Gaya in connection with Wazirganj PS case No. 258/ 2022, subject to conditions laid down u/s 438(2) of the Cr. P. C.
