ANJANA MISHRA ORAL ORDER 27-05-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is custody since 04.10.2014 in connection with Sheohar P.S. Case No. 182/14 registered for the offences punishable under Sections 379 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner was not named in the First Information Report but subsequently, the petitioner was arrested 03.10.2014 and was made to confess before the Police that he has stolen the aforesaid motor-cycle with one Ganesh Mahto. Learned counsel submits that the petitioner has not given any confessional statement rather he has been trapped by the Police officials.

Considering the aforementioned submissions and the period of custody and that the confessional statement made before the

Patna High Court Cr.Misc. No.12374 of 2015 (3) dt.27-05-2015 P2/2 Police has no evidentiary value, let the petitioner Arun Yadav be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheohar in connection with Sheohar P.S.
