Mr.Jai Narain Thakur ====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 05-02-2019 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in Cheriya Bariyarpur P.S. Case No. 136/2017, instituted for offences under Section(s) 363, 366(A), 504, 323/34 of the Indian Penal Code. It is alleged in the written report that daughter of informant, aged about 13 years, was found missing from house. During search, informant received call of her daughter on her mobile that she has been kidnapped by 3 to 4 persons. Victim girl, on recovery, has given statement under Section 164 Cr.P.C., which is enclosed as Annexure-2, wherein she has stated that this petitioner had taken her to different places by train and also committed illegal act with her.

Patna High Court Cr.Misc. No.3319 of 2019(3) dt.05-02-2019 2/2 From the narration of victim in the statement recorded under Section 164 Cr.P.C., it appears that victim had gone to different places with this petitioner voluntarily. Petitioner is in custody since 02.07.2018.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Manjhaul, Begusarai in connection with Cheriya Bariyarpur P.S. Case No. 136/2017, subject to the conditions that both the bailors shall be the close relative of the petitioner.
