2. The petitioner has prayed for the following reliefs: (i) for issuance of an appropriate for cancellation of settlement of 105 Bigha land of Awadh Bihari
2/4 Sanskrit College Rahimpur, Police Station-Muffasil, DistrictKhagaria, which has been settled by the respondent no.6 violating the all norms and procedure without any open auction;
(ii) for issuance of an appropriate to dispose off the representation filed by the petitioner with reasoned and speaking order, but the same is still pending;
(iii) for issuance of an appropriate writ in the nature of mandamus or any other appropriate writ or writs to conduct high level enquiry with regard to the settlement of 105 Bigha land of Awadh Bihari Sanskrit College Rahimpur, Police Station-Muffasil, District-
3/4 Khagaria, which has been settled by the respondent no.6 without following the procedure of open auction and such persons, who have criminal antecedent or such persons, who has already possessing the land;
(iv) for issuance of an appropriate to check and balance the irregularities increasing day to day in settlement of the land by the authorities concerned;
(v) for issuance of any other appropriate writ/writs, order/orders, direction/directions for which the writ petitioner will be found entitled in the facts and circumstances of the case.
3. If the allegation that has been made by the writ
4/4 petitioner in the petition is correct, it is time for the Collector, Khagaria to look into the matter and take remedial measure.
4. Only because the concerned Sub-Divisional Officer, Khagaria has not been made party respondent by name, this Court has refrained itself from putting him on notice.
5. The petitioner submits that he will be filing all relevant documents alongwith the fresh representation before the Collector, Khagaria. Learned State Counsel who has also gone through the contents of the writ petition and he submits that the issue is of serious nature.
6. The petitioner to file a representation alongwith all relevant documents before the District Magistrate, Khagaria within four weeks.
7. If such an application is filed, the District Magistrate, Khagaria shall take the matter to its logical conclusion within a period of four months thereafter.
8. The writ petition stands disposed of.
