JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-01-2020 This is an application for grant of anticipatory bail in connection with Bikram P. S. Case No.273 of 2019 disclosing offences under Sections 420, 323, 380, 354, 504, 506, 307 of Indian Penal Code and Section 27 of the Arms Act. As per complaint case, it is alleged that there was an agreement between the informant's husband and the petitioner that the informant's husband would pay Rs. 3,33,400/- within six months and other family members, i.e., father-in-law, brother-inlaw and after receiving agreed entire amount, they have to leave the house. It is further alleged that the husband of the informant agreed to pay the entire amount and requested to vacate the house, but they got annoyed and on order of Umesh Yadav, he outrage the modesty and torn the blouse of the complainant. No.1679 of 2020(2) dt.14-01-2020 2/3 further alleged that other accused persons entered inside the house and took away box containing gold ornaments and silver worth Rs. 1,00,000/-, cash Rs.20,000/- and other articles. It is further alleged that Usha Devi also snatched away the Mangal Sutra from the neck of complainant worth Rs.30,000/- and Meera Devi snatched away ear ring from the ear of the complainant. Further allegation is of assault by lathi and danda, causing injury to her. Further allegation of firing on the husband of the complainant.

Submission of the learned counsel for the petitioner is that there is a property dispute between the petitioner and husband of the complainant with respect to that earlier the husband of the complainant has lodged the case against the petitioner of firing and later on, the father-in-law of the petitioner has also lodged a case against the informant. Heard learned A.P.P. also.

Having heard both sides, considering the above submissions, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of VI
