JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-06-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be husband of the deceased and in course of investigation witnesses including own brother in law of the deceased stated that marriage of deceased had forcibly been solemnized with the petitioner and she had committed suicide at her natal place. The aforesaid fact is evident from perusal of several paragraphs of the case diary, particularly, para-27 of the case diary which is the statement of own brother in law of the deceased. Moreover, the Investigating Officer has submitted charge sheet for the offence punishable under Section 306 of the Indian Penal Code.
Considering the aforesaid facts and circumstances as
Patna High Court Cr.Misc. No.13580 of 2015 (3) dt.29-06-2015 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Kumar Gunjan, Judicial Magistrate 1st Class, Araria in connection with Narpatganj P.S. Case No. 100 of 2009.
