Heard learned counsel for the petitioner as well as leaned Additional Public Prosecutor for the State. The petitioner is languishing in jail custody since 2201-2015 in a case registered under Sections-363, 366A/34 of the Indian Penal Code.

The victim has already returned to her home safely and her statement under Section-164 of the Cr. P.C. was recorded in which, she stated that the petitioner along with some unknown persons, forcibly took her but she was, later on, dropped on the way and according to statement of the victim, the petitioner did nothing wrong with her and the age of the victim was assessed by

Patna High Court Cr.Misc. No.14506 of 2015 (2) dt.09-04-2015 learned Magistrate as 16 years.

Considering the aforesaid facts and circumstances as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Triveniganj P.S. Case No. 113 of 2014 to the satisfaction of Sri Sakal Ram, learned Judicial Magistrate-Ist Class, Supaul. (Hemant Kumar Srivastava, J) A.K.V./- U T
