JUSTICE ASHUTOSH KUMAR ORAL ORDER 24-02-2022 Heard Mr. Lokesh Kumar Singh, learned Advocate for the petitioners and learned APP for the State. The petitioners seek bail in anticipation of their arrest in connection with Gopalpur P. S. Case No. 142 of 2020, instituted for the offences under Sections 341, 323, 324, 307, 504 and 34 of the Indian Penal Code. All the three petitioners are said to have assaulted the members of the prosecution party, leading to injuries on their person. Except for one of the victims, all others are said to have received simple injuries. Even the informant

Considering this aspect of the matter, the casediary was called for and the petitioners were granted provisional bail by order dated 04.01.2022.

The case-diary has since been received along with the injury report.

With respect to the injuries on other victims, the injuries have been found to be simple in nature. With respect to the injuries suffered by the informant, further investigation had been suggested. Till date, no report is forthcoming regarding the final assessment of the injury of the informant.

However, from the dimensions of the injuries suffered by the informant, it appears that it cannot be life threatening.

Considering this aspect of the matter, the provisional bail granted to the petitioners is, hereby, confirmed. The petitioners shall remain on the same bailbonds.
