The petitioner seeks bail in connection with Bikramranj P.S. Case No. 557 of 2024 instituted for the offence under Sections 103(1), 238(a) & 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Sections 25(1-b)a, 26 & 27 of the Arms Act. 3.
As per prosecution case, it is alleged that coaccused, namely, Anand Kumar murdered the husband of the informant by licensed gun.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 22-09-2024. Petitioner bears no criminal antecedent/s, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. It is submitted that there is specific allegation against coaccused Anand Kumar @ Badal. The petitioner has no role in killing the husband of the informant. He is implicated merely because he is the father of the accused Anand Kumar. Similarly situated co-accused has been granted bail by a Co-ordinate Bench of this Court vide order dated 21-02-2025, passed in Cr. Misc. No. 5026 of 2025.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.
Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner, there being no direct allegation against the petitioner and claim based on parity this Court is inclined to grant bail to the petitioner. 8.
Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Bikramranj P.S. Case No. 557 of 2024.
