JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 03-03-2016 Heard learned counsel for the petitioners and learned A.P.P. representing the State.

The petitioners seek bail in connection with Barun P.S. Case No. 217 of 2013 registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code. Petitioners are not named in the First Information Report and during course of investigation co-accused Rajendra Thakur confessing his guilt stated the name of the petitioners also but that Rajendra Thakur has already been allowed bail vide order dated 19.01.2015 passed in Cri. Misc. No. 33820 of 2014 by another co-ordinate Bench of this Court. Chargesheet has already been submitted and there is no chance of tampering with

No.6973 of 2016 (2) dt.03-03-2016 the prosecution evidence In the facts and circumstances stated above, the petitioners, above named, are also directed to be released on bail on execution of bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Aurangabad in connection with Barun P.S. Case No. 217 of 2013 subject to the conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioners shall remain present on each and every date during trial and the default on two consecutive dates on their part without any reason shall disentitle the petitioners from privilege of bail.
