Learned counsel for the petitioner undertakes to remove the defects within four weeks of resumption of normal court proceeding. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the Bench. The petitioner seeks bail in connection with Bisfi P.S. Case No. 242 of 2020 corresponding to G.R. No. 641 of 2020 registered for the offence punishable under Section 302/34 of the Indian Penal Code.
Allegation against the petitioner is that petitioner along with his son who is husband of the deceased are involved in killing daughter of the informant. It is alleged that petitioner told the husband of the deceased that his wife used to go out with any one without petitioner's permission, on which husband of the deceased
Patna High Court CR. MISC. No.13352 of 2021(3) dt.24-08-2021 2/2 came and brutally assault her with lathi and by pressing her neck with rope as a result of which she died.
Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case and has not committed any offence as alleged in the FIR. He submits that petitioner is mother-inlaw of the deceased. He submits that there is no specific overt act against the petitioner as specific allegation of killing the deceased is against husband of the deceased and husband is already in jail custody. Charge sheet has been submitted in the present case. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. The petitioner is a lady having no criminal antecedent as has been mentioned in para 3 of this bail petition and she is languishing in custody since 31.07.2020. Learned APP for the State opposed the bail petition.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor Court in connection with Bisfi P.S. Case No. 242 of 2020 corresponding to G.R. No. 641 of 2020. (Anjani Kumar Sharan, J) GAURAV S.
