2. The petitioner seeks bail in connection with Jiyapokhar P.S. Case No. 33 of 2023 registered for the offence under Sections 8(c)/21(b) of the NDPS Act.

3. As per the prosecution case, 10.51 gms of Brown Sugar has been recovered from the petitioner.

4. It has been submitted by the learned counsel for the petitioner that the petitioner is innocent and he is in custody since 20.9.2023.

5. Considering the aforesaid facts, this application is allowed.

6. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)

Patna High Court CR. MISC. No.4861 of 2024(3) dt.09-04-2024 2/2 with two sureties of the like amount each to the satisfaction of the learned Sessions Judge-cum-Special Judge (NDPS) Act, Kishanganj in connection with Jiyapokhar P.S. Case No. 33 of 2023.

7. As a condition of this order, the petitioner after being released on bail is directed to mark his attendance at Garbhandhanga Police Station on first Sunday of each month.
