This is a petition for grant of regular bail for offence under Sections 302, 120B, 147, 148 and 149 of the Indian Penal Code and 27 of the Arms Act. It has been submitted on behalf of the petitioner that the informant is not an eye witness to the occurrence though by claiming herself to be an eye witness, she has made no specific allegation against the petitioner, which is evident from the last portion of the first information report. It is, further, submitted on behalf of the petitioner that omni bus and general allegation has been made against the petitioner and others. It is, further, submitted that the petitioner is in jail since 23.07.2014.
On behalf of the State it has been submitted that the petitioner is named in the first information report and he has placed an active role in course of the occurrence.
Patna High Court Cr.Misc. No.15850 of 2015 (2) dt.09-06-2015 2/2 Considering the aforesaid facts and circumstances, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Halsi P.S. Case No. 71 of 2014 to the satisfaction of Sri Om Shankar, Judicial Magistrate, 1st Class, Lakhisarai.
