JUSTICE MOHIT KUMAR SHAH ORAL ORDER 16-04-2018 The only issue raised in the present writ petition is that the case of the petitioner herein is same as that of one Surendra Singh, hence, the petitioner ought to have been granted the benefit of second A.C.P as has been granted to the said Surendra Singh.
The learned counsel for the Respondents disputes the position and submits that though the said Surendra Singh was absorbed on 18.12.1993 in the regular establishment, the petitioner herein was absorbed only on 27.05.2002, hence, the case of the said Surendra Singh is different from that of the petitioner herein. It has further been stated that by an order dated 14.01.2013, the case of the petitioner has been rejected as
Patna High Court CWJC No.10044 of 2017(2) dt.16-04-2018 2/2 far as the grant of the benefits of second A.C.P. is concerned and the said order which has been passed by the Screening Committee has not been challenged till date.
In view of the aforesaid, I do not find any merit in the present writ petition, however, if so advised, the petitioner may challenge the aforesaid order dated 14.01.2013 passed by the Screening Committee.
The writ petition is dismissed with the aforesaid liberty.
