The petitioner is in custody since 18.02.2015 in connection with Kanhauli P.S. Case No. 17 of 2015 registered for the offences punishable under Section 414, 467, 468, 471, 420/120(B) of the Indian Penal Code.

The prosecution case is that one Motay Savaiya a Sub Inspector of Police, Kanhauli Police Station, Distt. Sitamarhi has written his self statement on 17.02.2015 alleging that he has got confidential information that a Tata Sumo Victa vehicle is standing in Village Falkaha which appears to be stolen vehicle, on such information the informant proceeded and found a Tata Sumo Victa was standing in which a person was sitting. On query that

Patna High Court Cr.Misc. No.17061 of 2015 (4) dt.12-08-2015 2/2 person disclosed his name as Ranjit Kumar and he has disclosed that he is the owner of the vehicle. The informant searched the vehicle and found a owner book (smart card) a driving license of the petitioner and a Voter-I card of the petitioner has been found accordingly the informant prepared the seizure list on 11.02.2015 itself. The said seized documents appeared to be fake. Learned counsel for the petitioner submits that he has clean antecedent and has no concern with the seized vehicle. It has further been submitted that although the incident is of 11.02.2015 but the F.I.R. has been lodged on 17.02.2015, when the SubInspector of Police had himself conducted such raid. Under the aforesaid circumstances, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Kanhauli P.S.
