JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-02-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are named in the first information report but allegation against petitioner No. 2 is that he along with some others assaulted the informant whereas; allegation against petitioner No. 1 is that he assaulted the injured, Dileep Kumar. Annexure-3 series to this petition reveals that both the above-said injured sustained simple injuries. So far as deceased is concerned; it is, specifically, stated in the first information report that it was co-accused, Ram Lagan Mahto, who caused fatal injury to the deceased.

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioners

Patna High Court Cr.Misc.
