JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 07-05-2015 Learned counsel for the petitioner Akhilesh Mandal is permitted to make necessary correction in the petition. Heard learned counsels for the petitioners and the State.

The petitioners are languishing in custody since 15.09.2014 in a case registered for the offences punishable under Sections 25(1-A) (1-B)a/26/35 of the Arms Act. From the possession of petitioner Akhilesh Mandal two loaded country made postol and 19 live cartridges and from petitioner Bholi Mandal one loaded pistol and 8 cartridges and from petitioner one country made musket and 19 live cartridges were recovered.

It is submitted by learned counsel for the petitioner Akhilesh Mandal that he is accused in three other cases whereas Bholi Mandal is accused in two other cases and Chhotu Yadav is accused in seven other cases.

Considering the fact that investigation has already concluded and the period under custody, let the above named petitioners, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like

Considering the criminal antecedent of the petitioners, the learned court below will be at liberty to cancel the bail bonds of the petitioners, if he substantially get involved in some serious nature of the offence or default for two consecutive occasions.
