The petitioner seeks bail in connection with Rajpur P.S. Case No. 262 of 2019, registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The accusation is that on receiving information about presence of Ajit Sah in village Bahuara to supply the liquor to his associates, the informant, along with other police personnel, reached there. After short interval, one while coloured vehicle came in which four persons were boarding and, thereafter, two motorcycles also reached near the while colour vehicle and the occupants of the while colour vehicle started to talk with the persons who were on motorcycles. On chase, two persons, who were on motorcycles and four persons, who were on white coloured vehicle, apprehended. On search of white colour

Patna High Court CR. MISC. No.1249 of 2020(2) dt.21-01-2020 2/2 vehicle, 13 bottles, each containing 180 ml Indian made foreign liquor kept in cartons recovered. The person who was on Platena motorcycle, disclosed his name Baliram Chauhan and other person who wase another motorcycle disclosed his name Arjun Singh (petitioner), the four persons who were in white colour vehicle disclosed their name Ajit Sah, Rajiv Kumar, Bhupendra Singh and Dharmendra Chauhan.

Submission is that it would appear from the first information report that nothing was recovered from the motorcycle, which is said to be driven by the petitioner. the petitioner has no criminal antecedent and is in custody since 22.11.2019.

Having regard to the facts and circumstances of the case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Rajpur P.S. Case No. 262 of 2019 to the satisfaction of the Additional Sessions Judge II-cum-Special Judge, Excise, Buxar. (Rajendra Kumar Mishra, J) Shamshad/- U T
