This application, for grant of anticipatory bail, arises out of Jamui Police Station Case No. 396 of 2018, disclosing offences under Sections 341/323/447/379/354B/307/34 of the Indian Penal Code.

Learned Counsel appearing on behalf of the petitioner has submitted that before lodging of the present case, mother of the petitioner had got registered a complaint case against the informant, which is the reason why the present false case has been registered. It has been argued that the injuries have been found to be simple in nature, caused by hard and blunt substance, which belies the case of the prosecution.

Accordingly, this application is allowed.

Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui, in connection with Jamui Police Station Case No. 396 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
