An order dated 22.11.2014 passed by learned District and Sessions Judge, Buxar in Sessions Trial No. 65 of 2012 arising out of Buxar Town PS Case No. 231 of 2011 is under challenge in the present application filed under Section 482 of the Code of Criminal Procedure, 1973 (hereinafter Referred to as 'the Code'), whereby the petitioner's application to recall the investigating officer for examination at the trial has been dismissed.

3. The matter has remained pending for more than four years. It appears that the matter is not being pressed because of the subsequent development in the trial, in the meanwhile. Even otherwise, from perusal of the impugned

Patna High Court CR. MISC. No.10249 of 2015(2) dt.07-05-2019 2/2 order, I do not find any legal infirmity, warranting this Court's interference in exercise of power under Section 482 of the Code.
