JUSTICE SUDHIR SINGH ORAL ORDER 23-08-2016 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case instituted under Section 370 of the Indian Penal Code, 23 of the J.J. Act, 2000, 16 Bonded Labour Act, 1976 and 14 Child Labour Act, 1986. Allegation against the petitioners is that they were found taking some children to Chennai for employment. On query they failed to produce any document with regard to their employment. It has been submitted on behalf of the petitioners that they are in custody since 31.3.2016. Chargesheet has been submitted against the petitioners. They have got no criminal antecedent. No allegation of tampering of witnesses is alleged against the petitioners. Petitioners are not concerned with the
Patna High Court Cr.Misc. No.26379 of 2016 (3) dt.23-08-2016 2/2 children who were traveling to Chennai. Merely on presumption that the said children were being carried by the petitioners, they have been made accused in the present case.
On behalf of the State, it is submitted that petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, in connection with Sursand P.S. Case no. 50 of 2016.
