JUSTICE MOHIT KUMAR SHAH ORAL ORDER 11-04-2023 The present writ petition has been filed seeking the following relief:- "That this is an application for issuance of a Writ in the nature of Mandamus, commanding the Respondent Nos.1 to 4 to remove the encroachment made over public land of Khata No.187, Plot No.884 by Respondent Nos.5 and 6, which is public road and used by general public of locality on amongst others."

At the outset, the learned counsel for the

Patna High Court CWJC No.2510 of 2017(2) dt.11-04-2023 2/2 respondent-State has submitted, by referring to the counter affidavit, filed in the present case that the Circle Officer, Harsidhi, East Champaran has already initiated encroachment proceedings vide Encroachment Case No.19 of 2017-18, wherein the encroachers have appeared and filed their obections, which are being examined, hence, the proceedings of the aforesaid encroachment case would definitely be taken to its logical conclusion, within a fixed time frame.

Accordingly, the writ petition stands disposed off with a direction to the Circle Officer, Harsidhi, East Champaran to conclude the proceedings of the aforesaid Encroachment Case No.19 of 2017-18 by passing the final order under Section 6(1) of the Bihar Public Land Encroachment Act, 1956, in accordance with law, within a period of six weeks from today.
