JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 25-01-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Parbatta P.S. Case No. 85 of 2018 for the offence under Section 273 of the Indian Penal Code and Sections 30(a) and 38(1) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 05.09.2018. In the instant case, 72 litres of foreign liquor was seized. He submits that the petitioner has no concern with the liquor and he was only a passenger in the Auto from which the liquor was seized.

Considering the fact that the petitioner has got no criminal antecedent, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each
