The petitioner seeks bail in Barbigha P.S. Case No. 34 of 2014, registered for the offences punishable under Section 395 and other Sections of the Indian Penal Code.

The petitioner is not named in the FIR. The petitioner was arrested in Sheikhopur Sarai P.S. Case No. 13 of 2014 registered under Section 395 of the Indian Penal Code and some articles were recovered from possession of the petitioner.

Learned counsel for the petitioner submits that the petitioner was not put on test identification parade and the recovered articles were also not put on test identification parade. There is no material to show the involvement of the petitioner. The petitioner has already been granted bail in Sheikhopur Sarai P. S. Case No.

Patna High Court Cr.Misc. No.11637 of 2015 (2) dt.07-04-2015 2/2 13 of 2014 vide order passed in Cr. Misc. No. 44694 of 2014 on 19.03.2015.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sheikhpura in connection with Barbigha P.S.
