1. Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 191(1), 126(2), 115(2), 109(1) and 303(2) of the BNS.

Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and petitioners no. 3 and 7 are women and the informant alleges that on 27.08.2025, at 01:00 p.m., 16 named accused persons including the petitioners along with 8-9 unknown accused came and started abusing. On objection, Krishna with rod and Brihspati with lathi assaulted the informant causing injury on head, thereafter, accused assaulted Bechan and informant's mother by sword causing injury on leg and also assaulted his father, namely, Chamaru, thereafter, assaulted Adhin, Rambilash and Bipin. It is next alleged that Basanti snatched chain of the mother and daughter-in-law of the informant.

4. Learned counsel for the petitioners submits that petitioners and the informant are related and are having dispute relating to land. It is further submitted that at para 12 of the anticipatory bail application, it has been specifically pleaded that the injuries are simple except one injury of Adhin but then allegation of assault is not specific. It is next submitted that even the injury of Adhin, which has been opined to be grievous, is on non-vital part of the body, i.e., finger. It is also submitted that petitioners are not criminals.

5. Learned A.P.P. for the State opposes the prayer for

Patna High Court CR. MISC. No.4768 of 2026(2) dt.23-03-2026 3/3 anticipatory bail of the petitioners.

6. Considering the submissions made by the learned counsel for the petitioners, let the petitioners, above-named, in the event of their arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Trial Court where the case is pending/Successor Court in connection with Surajgarha P.S. Case No. 250 of 2025, subject to the conditions as laid down under Section 438(2) of the Cr.P.C./482(2) of the B.N.S.S.
