Learned counsel for the petitioner submit that though the bail petition of the petitioner was earlier rejected by this court vide order dated 23.09.2014 in Criminal Misc. No. 24262 of 2014 and the petitioner is in jail since 27.01.2014 however the case has not been yet communicated to the court of Sessions and the case is still fixed at the stage of providing the police paper. This is horrible state of affairs that person in jail since 2014 has not been provided with police paper and the case has been committed learned District and Sessions Judge, Samastipur, is directed to be within a matter.

However, the case for offence punishable under

Patna High Court Cr.Misc. No.14341 of 2015 (4) dt.20-04-2016 2/2 Section 307 taking into consideration the period of custody the petitioner is ordered to be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Rosera, at Samastipur, in connection with Singhia P.S. Case No. 125 of 2013 subject to the condition that one of the bailors shall be near relative. The petitioner shall appear on each and every date fixed by the court by the court below. In case of default in appearance on two consecutives dates, the trial court shall have liberty to cancel his bail bonds.
