Petitioners apprehend their arrest in Belaganj P.S. Case No.273 of 2018 for the offences allegedly committed by the petitioners under Sections 308, 379, 354, 325 and other minor sections of the Indian Penal Code.

The informant alleged that his daughter had gone to attend the call of nature but the petitioners and others tried to outrage her modesty and on protest they assaulted the daughter of the informant and also snatched ornaments from his neck. Learned counsel for the petitioners submits that true facts are that prior to institution of the case, Chinta Devi, the wife of petitioner no.1 lodged Belaganj P.S. Case No.272 of

Patna High Court Cr.Misc. No.3297 of 2019(2) dt.24-01-2019 2/2 2018 against the informant and others. They brutally assaulted Pawan Paswan on petty dispute. In order to save their skin, the present case was lodged. It is further submitted that police after investigation found that the present case was lodged only to save the skin of the informant and others as some dispute arose between the two sides for solemnization of marriage of the daughter of the informant.

Considering the facts aforesaid and nature of allegations made against the petitioners and the fact that there is case and counter case, let petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of this order be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-XIth, Gaya in connection with Belaganj P.S. Case No.273 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C. (Prabhat Kumar Jha, J) S.KUMAR/- U T
