2. The petitioner apprehends his arrest in connection with Nalanda P.S. Case No. 121/ 2024 dated 31.07.2024 registered for the offence(s) punishable under Section(s) 420, 467, 468, 471 and 120B of the IPC.

3. As per the prosecution's case, this petitioner got appointment on the post of Panchayat Teacher on the basis of forged and fabricated educational certificates.

4. The main submissions advanced by petitioner's counsel are that the FIR of the instant matter was registered in following with the direction given by the Division Bench of this court in CWJC No. 15459 of 2014 and the educational documents submitted by a number of teachers while getting appointment on the post of Teachers were verified and during that course as per the allegation, the petitioner's marksheet was found to be fake as per the verification report but only some

No.1968 of 2025(2) dt.05-02-2025 2/2 difference with regard to total marks was found in the marksheet submitted by the petitioner and there is no allegation of interpolation to the marks in the marksheet shown by the petitioner. It is further submitted that the petitioner has fair and clean antecedent and he has tendered his resignation on 09.09.2020 and he himself did not change the marks in his mark-sheet.

5. Learned APP appearing for the State has opposed the bail prayer of the petitioner.

Having considered the seriousness of the allegation which relates to getting Government employment on the post of Teacher on the basis of fake marksheet and there is sufficient documentary evidence to substantiate the allegation of forgery as well as using fake documents by this petitioner and he remained in service for several years and succeeded in getting salary and thereby caused huge monetary loss to the State Government, in my opinion, it is not a fit case for grant of anticipatory bail to the petitioner. Accordingly, his prayer stands rejected.
