The petitioner seeks bail in Khaira P. S. Case No. 520 of 2018 instituted for the offence under Section(s) 392 of the Indian Penal Code.
The F.I.R. alleges that the informant and his brother were travelling on their motorcycle when the named accused persons, four in numbers, have taken away the collection machine, two receipt books, bike papers and a purse carrying Rs,2,600/-, two mobile phones and motorcycle.
The petitioner's counsel submits that upon confessional statement of co-accused recorded in the course of investigation,
Patna High Court CR. MISC. No.1859 of 2020(2) dt.14-01-2020 2/3 he has been named in the instant case merely on suspicion. He is in custody in connection with instant case since 10.07.2019. There is no recovery of any incriminating articles from the petitioner's possession and other then the confessional statement of co-accused, there is nothing to connect the petitioner with the alleged occurrence. After his implication in Jhajha P.S. Case no. 206 of 2015, in all other cases lodged in the area of similar nature, he is being implicated alleging disclosure in confessional statement of co-accused.
The learned APP for the State opposed the prayer for bail. Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the CJM, Jamui, in connection with Khaira P. S. Case No. 520 of 2018 subject to the following conditions:- (i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.
(ii) That the petitioner will be well represented on
Patna High Court CR. MISC. No.1859 of 2020(2) dt.14-01-2020 3/3 each date and if he fails to do so on two consecutive dates, his bail bond will be liable to be cancelled.
