The petitioner seeks bail in connection with Bihar P.S. Case No.419 of 2019 registered under Section 414 of the Indian Penal Code besides Sections 25(1-B)A, 26 and 35 of the Arms Act.
The accusation is that in course of raid of the house of Shankar Mahto, situated in village-Naisarai Narsariganj, by the police party, four persons, namely, Shankar Mahto, Chanchal Kumar alias Paplu, Rakesh Kumar and Uday Kumar alias Sunil Kumar (petitioner), were apprehended and on search, three country made pistols, one country made revolver, 55 live cartridges and Rs.9200/- were recovered from the bed of the
Patna High Court CR. MISC. No.2787 of 2020(2) dt.24-01-2020 2/2 room of the house of Shankar Maho. From the pocket of Shankar Mahto, one mobile set was recovered. The petitioner and two others were found in possession of the mobile sets. Learned counsel appearing on behalf of the petitioner submits that no incriminating was recovered from the possession of the petitioner and, on mere suspicion, the petitioner has falsely been implicated in this case. The petitioner is in custody since 05.07.2019.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda at Biharsharif, in connection with Bihar P.S.
