The petitioner was neither caught at the spot nor anything was recovered from his conscious possession and so far as criminal antecedent of the petitioner is concerned; except the present case and one another case i.e. Koperkherne (Wasi) Mumbai P.S. Case No. 292 of 2013, there is no any other case against the petitioner.

Accordingly, the petitioner named-above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Ghorasahan P.S. Case No. 171 of 2012 to the satisfaction of Sub Divisional Judicial Magistrate, Sikrahana at Motihari, East Champran.
