JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. No doubt, petitioner is not named in the first information report but in course of investigation, some witnesses stated that petitioner was a drunkard and on the alleged date of occurrence, a quarrel had taken place between him and deceased, who happened to be wife of the petitioner. The post mortem report of the deceased reveals that cause of death of the deceased was strangulation. The dead body of the deceased was found within the four-walls of house of the petitioner and, therefore, the aforesaid circumstantial evidence prima facie points out finger towards the guilt of the petitioner.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.4249 of 2016 (3) dt.25-02-2016 2/2 well as submissions of the parties, I am not inclined to release the petitioner on bail, at least, at this stage and hence, his prayer for bail in connection with Parsa P.S.
