JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The trial court has reported that uptill now, charge could not be framed.
Earlier prayer for bail of the petitioner was rejected but the petitioner is in jail custody since 29-06-2015 in case registered u/Ss 457, 376/511 of the Indian Penal Code. However, taking note of allegation as well as submissions, prayer for bail of the petitioner in connection with Garkha P.S. Case No. 130 of 2015 corresponding to Sessions Trial No. 606 of 2015 is, again rejected with this observation that the petitioner may renew his prayer for bail before the learned trial court itself after framing of charge.
