Mr. Pramod Kr. Pandey, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 24-02-2025 Heard Mr. Pankaj Kumar, learned counsel appearing for the petitioner and Mr. Pramod Kumar Pandey, learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 126(2), 115(2), 117, 125, 109, 303(2) and 3(5) of the B.N.S..

3. As per prosecution case, it is alleged that this petitioner along with co-accused Akhilesh Singh assaulted son of informant and also snatched mobile phone and Rs. 1,000/- cash. When husband of informant reached there, co-accused Akhilesh Singh hit him breaking the bone of his nose. It is further alleged that all the accused persons assaulted son of informant and this petitioner assaulted with lathi.

4. It is submitted by learned counsel appearing on

Patna High Court CR. MISC. No.4145 of 2025(2) dt.24-02-2025 2/3 behalf of the petitioner that petitioner is innocent and has committed no offence. As a matter of fact, a quarrel took place between the onwer of P.D.S. shop and son of informant on a petty issue and in retaliation this petitioner and entire family members have been made accused in this false and concocted case. Petitioner is not the P.D.S. dealer and had no motive or grievance against the informant. It is further submitted that even in the F.I.R., no motive has been alleged against this petitioner as to why he assaulted son of informant. Injuries allegedly caused by this petitioner are simple in nature.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.

6. Considering the aforesaid facts and circumstances, nature of accusation and nature of injuries sustained by the injured, the prayer for grant of anticipatory bail to the petitioner is allowed.

7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial
