JUSTICE MOHIT KUMAR SHAH ORAL ORDER 11-04-2023 The present writ petition has been filed seeking the following reliefs:- "1(i). For that the writ in the nature of mandamus commanding the petitioner has prayed from Hon'ble Court to direction of Authority to proper examined or removed of Encroached Land from bad elements and hand over encroached Land.

(ii) For that the petitioner had purchased 3 1/8 decimal of land from varth of registered sale deed on 13.12.2007 to name of vendee wife of Lakshmi Devi from vendor namely Shree Anandi Lal in respect of Khata no. 222

(iii) For that after some time the locality of bad element which has threatened to the petitioner and tell him you have doing this registree from name of aforesaid land other by you have died.

(iv) For that then thereafter look at the fear of the petitioner the bad element has filled up plain soil and Encroached.

(v) For that collusion that the petitioner has given application before the Authority of Thana Incharge of (S.P.) Sheikhpura alongwith Circle officer but they have not taken any action.

(vi) For that Circle officer has submission of document from bad element but they have not produced."

After some arguments, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies as are otherwise available under the law. Liberty, so sought, is granted.
