The petitioner is languishing in custody since 22.10.2018 in a case registered for the offence punishable under Sections 394 of the IPC.

The prosecution case, as per the written report of Md. Saddam, dated 21.10.2018, submitted to the Station House Officer, Bahadurpur Police Station, is to the effect that on

Patna High Court Cr.Misc. No.4154 of 2019(3) dt.31-01-2019 2/3 20/21.10.2018 at about 01.00 A.M. the informant was coming back from the house of his maternal uncle on motorcycle. On the way, three accused persons surrounded the informant and made his motorcycle stop and robbed Rs. 6,000/-, a wrist watch, a mobile phone and Aadhar card from the informant, leading to registration of FIR against three unknown persons. It is further alleged that during investigation, the name of the petitioner sprang up and from his possession, robbed mobile phone was recovered.

It is submitted by learned counsel for the petitioner that the investigation has already been concluded but till date the petitioner has not been put on T.I. Parade. It is further submitted that the petitioner was not named in the FIR. A statement has been made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent.

Learned APP for the State submits that the recovery of the robbed mobile phone was made from the possession of the petitioner.

Considering the fact that the investigation has already been concluded but the petitioner has not been put on T.I.P, period under custody, coupled with the statement made in paragraph no.3 of the petition that the petitioner is not having

No.4154 of 2019(3) dt.31-01-2019 3/3 any criminal antecedent, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned S.D.J.M., Darbhanga in connection with Bahadurpur P.S. Case No.462 of 2018.
