The petitioner seeks bail in a case registered for the offences punishable under Section 366A of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is in custody since 29.06.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. The informant alleges that on 27.06.2021, her minor daughter had gone to market and since then she is missing, it is next alleged that the victim used to talk to the petitioner thus it is alleged that the petitioner kidnapped her daughter with an intention to marry.

No.2932 of 2022(2) dt.25-05-2022 2/2 Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, the victim after coming back got her statement recorded under Section 164 of the Cr.P.C. where she disclosed her age as 17 years and did not support the prosecution case as would be evident from Annexure-2 to the bail application. Learned A.P.P. for the State opposes the prayer for bail of the petitioner.
Considering the fact that the petitioner is in custody since 29.06.2021, is a person with clean antecedent, chargesheet has been submitted in the case and the victim has not supported the prosecution case in her statement under Section 164 of the Cr.P.C., let the petitioner above named be released on bail on furnishing bail bond of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Haspura P.S. Case No. 112 of 2021.
