JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-03-2019 The petitioner apprehends his arrest in connection with Surajgarha (Piri Bazar) P.S.Case No. 25 of 2002 registered under Sections 307, 324 and 341 of the Indian penal Code, 27 of the Arms Act and 3 and 4 of the Explosive Substance Act. Allegation against the petitioner is of exploding the bomb. It appears that case is of the year 2002. Submission of learned counsel for the petitioner is that final form finding the case true has been submitted against the petitioner however cognizance was taken in the year 2003 and no notice was sent upon the petitioner and as such he could not file anticipatory bail application earlier.
Heard learned APP also.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant
Patna High Court CR. MISC. No.4091 of 2019(3) dt.11-03-2019 2/2 privilege of anticipatory bail to him rather he should surrender within a period of six weeks from the date of receipt of a copy of this order and make prayer for regular bail, which shall be considered on the basis of submission made above and also on the basis of material available on record, and disposed of if possible, on the same day.
