The petitioner is accused in connection with Kathaiya P.S. Case No. 121 of 2019, registered under Sections 272 and 273/34 of the Indian Penal Code and Section 30(a) of the Bihar Excise Act, 2016.

The accusation is of recovery of 45 cartoons each containing 12 bottles of 750 ml, 240 cartoons each containing 24 bottles of 375 ml and 255 bottles each containing 48 bottles of 180 ml Indian made foreign liquor from the truck. On seeing the police party, two persons including the driver of the truck succeeded to flee away while on chase, one person was apprehended, who disclosed his name as Salman Khan, who

Patna High Court CR. MISC. No.1490 of 2020(2) dt.23-01-2020 2/2 introduced himself as co-driver of the truck. Learned counsel for the petitioner submits that, in fact, the truck driver and one person, who are related to aforesaid seized materials, succeeded to flee away but petitioner being the co-driver of the said truck has been apprehended. It is further submitted that petitioner has no criminal antecedent and is in custody since 02.08.2019.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-cum-Special Judge, Excise, Muzaffarpur, in connection with Kathaiya P.S. Case No. 121 of 2019. Out of two sureties, one surety must be the close relative of the petitioner.
