JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report but according to the prosecution case itself, one Seema Devi had disclosed before the informant that 3 to 4 days prior to the alleged occurrence, petitioner was planning to kidnap the victim of the said case. Subsequently, co-accused Seema Devi was also made accused in the present case and confessed her guilt before the police disclosing the name of petitioner. The investigation against the petitioner has already been completed but admittedly, the victim could not be recovered. Moreover, it appears that except the above stated statement of co-accused Seema Devi, there is nothing against the petitioner who is languishing in jail custody

Patna High Court Cr.Misc. No.7224 of 2016 (2) dt.16-02-2016 2/2 since 28.09.2015.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jamui in connection with Khaira P.S. Case No. 207 of 2015.
