1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner has preferred this application for grant of regular bail in connection with Nawada Sadar P.S. Case no. 132 of 2022 registered under sections 420, 406, 467, 468, 471, 504 and 34 of the Indian Penal Code.

3. As per the prosecution case, the informant states that although he paid a total sum of Rs. 16 Lakhs, the accused persons including the petitioner herein did not execute the sale deed for which the aforesaid payment was made.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. From perusal of the F.I.R itself, it would be evident that the allegations relates to a civil dispute between the parties. The allegations of

Patna High Court CR. MISC. No.6847 of 2024(2) dt.17-02-2024 2/2 payment of amount of Rs. 16 Lakhs is contested and denied. The petitioner is in custody since 31.10.2023 and has no criminal antecedent.

5. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the nature of allegations against the petitioner in the F.I.R, his having remained in custody since 31.10.2023 and not having any criminal antecedent, the petitioner is directed to be enlarged on bail in connection with Nawada Sadar P.S. Case no. 132 of 2022, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada.
