2. The petitioner seeks bail in connection with Muffasil P.S. Case No. 644 of 2024 dated 27.07.2024 registered for the offence punishable under Sections 137(2)/96 of Bharatiya Nyaya Sanhita.
3. The prosecution case, in short, is that on the date of occurrence the daughter of the informant aged about 14 years went out from her home without giving any information to his family members. The informant searched her but he could not find. Later on, he got information that one Nitish Kumar has eloped with his daughter.

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. It is submitted that the petitioner is not named in the F.I.R. It is submitted that when the petitioner and the victim came to know about this false case, both of them appeared before the concerned police station on 18.08.2024. On the basis of statement recorded under Section 183 of BNSS on 19.08.2024, the petitioner has been made accused in this case. It is further submitted that the petitioner is aged about 19 years and has been falsely involved in the present case. It is also submitted that the victim in her statement recorded under Section 183 BNSS clearly stated that she left her house on her free will and went with the petitioner to Chennai.
It is submitted that the petitioner was medically examined and his age was assessed by the doctor to be 19 years and the age of the victim was assessed as 18-19 years by the Medical Officer, Parbhawati Hospital, Gaya. It is submitted that both the petitioner and the victim are major. It is submitted that there is no any allegation against the petitioner in the statement recorded under Section 183 of the BNSS.
Patna High Court CR. MISC. No.4013 of 2025(3) dt.22-03-2025 3/3 in custody since 28.08.2024, having no criminal antecedent and charge-sheet has been submitted in the case.
5. Learned A.P.P for the State opposes the prayer for bail of the petitioner.
6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Gaya in connection with Muffasil P.S. Case No. 644 of 2024.
