The petitioner seeks bail in connection with Jehanabad P.S. Case No. 351 of 2019, registered under Sections 147, 148, 149, 302, 120(B) and 324 of the Indian Penal Code and Section 27 of the Arms Act.

The accusation is that on 05.05.2019, in the evening, while informant Shashikant Kumar was returning to his house along with his father Saguni Yadav, in the way, nine persons named in the F.I.R., including the petitioner, variously armed with weapons came and caught hold his father and started to carry him then informant tried to flee then saw that Devendra Singh, Pawan Singh, Dharmendra Singh and Upendra Singh dragged his father behind the house of Devendra Singh and shot fire at his father in which his father

Patna High Court CR. MISC. No.1100 of 2020(2) dt.16-01-2020 2/2 sustained injury at his neck and chick as a result of which his father fell down. Thereafter, informant fled away raising alarm then villagers came and he found his father was lying on the ground pool of blood. The cause of occurrence is land dispute. Learned counsel for the petitioner submits that, although, the petitioner is named in the F.I.R., but no specific overt act has been attributed against the petitioner. The specific allegation is against co-accused Devendra Singh, Pawan Singh, Dharmendra Singh and Upendra Singh, who shot fire at the father of the informant. Further submission is that similarly situated co-accused Gunjan Singh has already been granted privilege of bail on 10.01.2020 by a co-ordinate Bench of this Court vide Criminal Miscellaneous No.

69752 of 2019. The petitioner is in custody since 26.09.2019. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-VII, Jehanabad in connection with Jehanabad P.S. Case No. 351 of 2019.
