2. By the order under contempt dated 03.12.2018 passed in CWJC No. 17429 of 2016, the writ petition came to be disposed of with a direction to respondent No. 4 to take a final decision pursuant to the communication dated 17.11.2017.

3. Learned Advocate for the petitioner submitted that in compliance with the order of this Court, the concerned District Education Officer as well as the District Programme Officer (Establishment), Begusarai, have come up with Memo

Patna High Court MJC No.148 of 2025(3) dt.28-11-2025 2/2 No.2032 dated 31.07.2019 and the petitioner has been accorded all the benefits of promotion, but surprisingly the same stood cancelled within a month vide a letter contained in Memo No. 2177 dated 19.08.2019. Further submission has been made that the Regional Deputy Director of Education has directed the authorities concerned to give emphasis upon the order of this Court and ensure the promotion as has been granted to the petitioner, however, the same has not been done. Hence this contempt application.

4. Having noticed the afore noted position this Court does not find any reason/occasion to continue with this contempt proceeding as a fresh cause of action has been accrued in favour of the petitioner. Accordingly, the present contempt application stands closed. However, the petitioner is at liberty to take appropriate action or challenge the order, if so advised.
