JUSTICE SANDEEP KUMAR ORAL ORDER 24-02-2026 Heard the learned counsel for the petitioner, the learned APP for the State, and the learned counsel for the alleged victim.
2. The petitioner apprehends arrest in connection with Dhansoin P.S. Case No. 131 of 2025 registered for offences under Sections 191(2), 190, 126(2), 115(2), 109, 121(2), 132, 324(2), 352, 351(2) of the Bharatiya Nyaya Sanhita, 2023.
3. As per the prosecution case, because of the civil dispute, the Circle Officer has filed the present FIR. The petitioner is accused of assaulting the victim.
4. Learned counsel for the petitioner submits that petitioner is quite innocent and has not committed any offence. He further submits that the petitioner is the brother of the main
Patna High Court CR. MISC. No.1851 of 2026(2) dt.24-02-2026 2/2 accused Ganesh Choudhary because of whom, the occurrence has taken place and the place has no role, and he cannot be benefitted in any way from the land dispute.
5. Learned APP for the State and the learned counsel for the alleged victim have vehemently opposed the prayer for bail.
6. Considering the aforesaid facts and circumstances of the case, this application for anticipatory bail stands allowed.
7. Accordingly, let the petitioner, above-named, in the event of arrest or surrender within four weeks from today in the Court below, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned concerned Court below, Buxar in connection with Dhansoin P.S. Case No. 131 of 2025 subject to the conditions as laid down under Section 482(2) of the BNSS.
