JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-03-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in jail since 04.01.2015 in a case registered for the offences punishable under Section 379 of the Indian Penal Code.
The accusation is of committing theft of TVS APACHI motorcycle bearing registration no.BR 39N 5402 and Bajaj Pulsar motorcycle bearing registration no. BR 39Q 0367 of one Md. Miraj, co-villager of the informant.
It is submitted by learned counsel for the petitioner that the motorcycle which has been recovered from the petitioner is black Glamour motorcycle which is not alleged to have been stolen. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named
