Heard learned counsel for the petitioner as well as learned counsel for the State.
The petitioner, who is husband of the deceased, apprehends his arrest in a case registered for offence under section 304B/34 of the IPC.
It is alleged that the petitioner with the aid of his family members subjected informant's daughter/the victim to cruelty for fetching dowry and on non-fulfilment of the same, all the accused persons strangulated her to death. Learned counsel for the petitioner submits that in fact the petitioner was in job in Bangluru when the occurrence took place. He submits that the victim was a lady of short temperament and on a trivial issue took place between her and his parents, she committed suicide. Other co-accused have already been allowed pre-arrest bail by different benches of this Court mentioned in paragraph 17 of the bail petition. While opposing the prayer for bail, learned counsel for the State submits that the marriage took place on 19.4.2019 and the alleged offence was committed by the petitioner and his family members on 18.9.2019. Witnesses have also supported the allegation levelled against the petitioner.

No.1745 of 2020(4) dt.26-08-2020 2/2 In view of the fact that the petitioner is the husband of the deceased, death has occurred in her matrimonial house within seven years of the marriage and there is allegation against the petitioner, prayer for bail of the petitioner is refused with direction to surrender and seek regular bail which would be considered on its own merit without prejudice.
