JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-02-2023 Earlier the bail application of the petitioner was dismissed as withdrawn vide order dated 14.11.2022 passed in Cr. Misc. No. 23917 of 2022 with liberty to surrender and seek regular bail.

It is submitted on behalf of the petitioner in Paragraph-13 that pursuant to aforesaid order passed by this Hon'ble court, petitioner filed a petition to surrender before the court below, but the learned court did not accept his petition, because case diary was not available on record. Only FIR was on record, in which, the petitioner is not named. In that view of the matter, if the petitioner surrenders in the court below, within a period of six weeks from today, the learned court below, shall accept the petition and pass appropriate order in accordance with law.
