This application has been filed by the petitioner under Article 227 of the Constitution of India praying for appointment of the petitioner as guardian and litem of the minor baby girl child named as Feeza Khatoon. Annexure 1 is the guardianship application filed by the petitioner under Section 8 of the Guardian and Ward Act read with Section 349 of the Mohammedan Law which has been numbered as Guardianship Case No.120 of 2010 wherein same prayer has been made by the petitioner which is still pending before the Principal Judge, Family Court, Gaya. Thus, this civil miscellaneous application is not maintainable before this Court for the same relief, as such, this civil miscellaneous application is dismissed.
